East Coast Confidential, LLC is a provider of legal services and would like the opportunity to earn a professional relationship with your legal firm. Our clients successfully receive the following services; process service, skip tracing and criminal and civil investigations. We effectively expedite the delivery of legal documents in accordance with the Virginia laws with respect to service of process. We are Professional Private Process Servers!

Our goal is to affect service in the least amount of time with a most professional approach. We don’t utilize process servers who are poorly trained. ECC investigators are discouraged from walking up to a subject and saying “You’re served!” This is a poor reflection of our profession as is often seen on television shows and movies. We identify the party whom we are serving; we describe the documents and offer them to the person. Of course there are the subjects who dodge service; in this circumstance our investigators are trained to be “creative” in locating the subject and having the subject served. As professionals, we will never leave legal papers with parties not qualified (with respect to the rules of civil procedure) to accept service. We will not leave papers to the wrong party due to our own failure or ineptness by improperly identifying whom we have spoken to.

We desire to build client relationships. We do not just want to get another law firm in the door to submit invoices to. We take our work seriously and work hard at establishing and keeping professional relationships. If you would like to arrange for an investigator to meet with you or anyone else from our firm, please do not hesitate to contact us. We value your business.

We do not claim to be the best in town. There are others just as competent who may have even been doing this longer. We will not claim to be the cheapest in town. However, we don’t do gutter serves and will not be leaving any papers at the door step if we have not properly identified the party whom we are serving. We are however, going to present ourselves as up-front, hard-working professionals. Our mission is to communicate with your office, determine your needs, and demonstrate our degree of integrity by providing you with reliability, accountability, honesty, and professionalism at the most affordable cost. If we take on the job, we will get it done. Once it is off your desk, rest assured, it’s in the hands of professionals who will then manage the paper for you every step of the way.

East Coast Confidential, LLC looks forward to doing whatever is necessary to help establish a working professional relationship for our future.

Information simply given

While the simple yelling of a child’s name in public when trying to get them off the playground, out of the store, or into the car or home will identify a family member by name. The same is true for anybody else hailed in this way by the subject. Knowing the person’s name makes it easy to strike-up a conversation about the subject to gather critical information that can be used to further and/or enhance the investigation.
Parking permits, school stickers, vacation magnets and the trendy stick people family stickers on the subject’s car, team shirts and other personalized items are a wealth of information to any Investigator who cares to notice. In minutes an Investigator could know the names of the subject’s kid and school, along with the subject’s favorite vacation spot and what sport he likes.

The Nature of Surveillance

As an aid to help our clients better understand the nature of the Private Investigation industry, the processes by which we work, and the regulations by which we are governed, we have prepared this information sheet so you may have more realistic expectations regarding the work   East Coast Confidential, LLC will conduct on your behalf.

1. We don’t have any more authority than does a private citizen.  We are not police officers.  The training, testing, background checks, and certification process we go through in order to obtain our licenses is meant to set us apart as individuals who are committed to unbiased professionalism.  As such, we are bound to rigid codes of conduct dictated by the State of Virginia and the Department of Criminal Justice Services..

2. Similarly, we are not attorneys.  Though we are very knowledgeable of the laws governing our actions, any advice we give concerning the direction or outcome of your case is merely a suggestion that should be approved by any legal representative you may have.

3. We are not magicians.  Ours is an industry revolving around detail gathered through available information, the understanding of this detail, and the working knowledge of how to follow the trails we uncover.  This detailed information is generated through diligence and knowing where to look.  Just as librarians are not geniuses, they simply are trained on where and how to find information.

4. Sometimes the information generated is contrary to what the client hopes to find.  We cannot guarantee results.  We can only guarantee that the necessary information, documentation, etc. will be searched for diligently, legally, expediently, and as economically as possible.

5. If surveillance is necessary we feel obligated to inform you of the “real life caveats.”  Surveillance, especially moving surveillance, is a hit and miss science.  We can perform these observations under agreed upon time and location parameters but cannot promise activity on behalf of the subject.  Similarly, moving surveillance carries with it inherent obstacles such as the unpredictable nature of traffic.  There is no guarantee that contact with the subject can be maintained as we cannot predict traffic flow, traffic conditions, weather, or other unforeseen problems.  As in number one above, we have no more authority than an ordinary citizen.  This includes traffic laws.  Similarly, privacy and private property laws will dictate the conduct of some surveillance.

6. East Coast Confidential, LLC can, however, make a promise that most of the other agencies can’t.  That is, we will do everything in our power to reach the goal of obtaining the information you need in a timely and economical fashion and conduct ourselves in a professional and discreet manner while representing you in your case.

Virginia Spousal Support and Alimony

Alimony is often referred to spousal support or maintenance and support. Alimony consist of periodic payments awarded to a financially dependent spouse when a couple ends a marriage in divorce. Alimony is not just the husband to pay but now the wife could be made to make the alimony payments. This all depends on each ones ability to provide for their own needs and the ability of the other spouse to provide for them. So if the wife was the main financial support and the husband mainly took care of the home and the children then the wife could be ordered to make alimony payments to the husband.

Alimony is mostly determined by a number of factors and the type of support you can receive. All of this varies from one case to another and from person to person depending on the deciding factors. The way you can receive the support either weekly, bi-weekly, monthly or in one lump sum and the length also varies.

There are two types of alimony:

Permanent Alimony is an indefinite support of alimony that only terminates with the death of either spouse or the remarrying of the dependent spouse.

Temporary Alimony is alimony awarded during litigation or as a rehabilitative alimony. Alimony during litigation also known as “pendent lite”, this is granted to the dependent spouse by the courts before the divorce is made final. This is usually done to help cover the living expenses of the dependent spouse and is usually awarded for a short time.

There are two categories of payments that follow the decree:

Technical Alimony is when the agreement states the payments are based upon conditions decided and set forth. When these conditions have been met or have NOT been met then it is possible to alter the amount of support.  Either spouse can petition the courts for an increase or a decrease in alimony payments.

Fixed Alimony is exactly how it is said; a fixed amount that cannot be altered or modified by the courts. This should be stated clearly in the agreement between the two.

Some of the factors that are used in determining the amount and duration are considered by most of the following factors below:

The obligations and financial needs and resources of both parties including but not limited to

All income and assets

Marital property

Financial obligations

Profit sharing and retirement

The earning ability of each party

What properties, if any do the spouses own?

Is either party making payments now and what money is owed?

Did one spouse stay home and keep house and care for the children while the other spouse obtained an education or worked to provide financially?

Which party has retirement benefits? With this the court can decide of a pension plan and benefits package to be able to protect the dependent spouse.

The earning ability of the dependent spouse

Has the person ever worked before

Some of the salaries or wages that were made

With that said salary is it possible to support their self and partially support the children

Is it financially realistic  for the spouse to stay home and care for the children rather

The opportunity, ability of and the time and cost for one to obtain the education or training to find suitable employment.

The standard of living during the marriage

The duration of the marriage

Usually the longer the marriage, the greater interdependence of the spouses and the lifestyle established.

Monetary and non-monetary contributions of each party

Did the stay at home duties enable the spouse to focus on building a career to support the family

The circumstances that lead up to the reason for divorce

The grounds for divorce are very important. In Virginia, the finding of Adultery, Buggery or Soddomy will bar permanent alimony. In a decision regarding “manifest injustice”, the degrees of fault during the marriage and the relative economic circumstances of the parties would be considered and would be an exception to the barring of permanent alimony.

The ages, physical and mental conditions of each party are considered

An older or disabled party is more likely to be awarded support than a younger, able bodied one.

The court will not award support to a person who is fully capable of working regardless of their desire to not work.

Any agreement between the parties

Are there any agreements or a separation agreement in place already

The ability of the party from whom alimony is sought to meet his or her own needs while still being able to provide the support of the dependent party

What does the financial future look like

What is the real income of the party

What financial assets that were gained as a couple

Is there going to be an increase or decrease in salary amount

Is there an inheritance expected

The Virginia code is interpreted by the courts mainly on a case by case basis and much of the law of alimony is contained in case law. You should always consult with your attorney to gain a full understanding of your alimony rights. East Coast Confidential can provide you with attorney referral and match you with the attorney best suited for your needs.

5 Rules for Divorce and Child Custody from a Virginia Private Investigator

The 5 Rules of Advice

From

East Coast Confidential, LLC

  1. I encourage you to keep a journal. Start one today and back date it with any information that you can remember. In this journal you would put everything inside; from important dates and times to conversations and incidents that occurred. If this is a divorce and or custody case then it could possibly be a year or so before you actually go to court. Trying to remember important dates or incidents will be hard to do especially during court when you may have to testify about these dates. Usually if you refer to your journal when you are asked to testify, your testimony will be much more credible.
  2. Do not sign anything with your spouse until your attorney has reviewed it. It doesn’t matter what it is, what it’s typed on, whether handwritten or notarized, do not sign it. If you make an agreement with your spouse that agreement can easily be made the court order in court. Do not legally bind yourself to an agreement without discussing where you stand with your attorney. If you do not have an attorney at this moment I advise you to retain one tomorrow. We have referrals if you would like help in choosing one.
  3. If your child/children are not living with you then I recommend paying child support to your ex partner as soon as possible. If your ex files for child support it could be several months before your case is heard by a judge. When a judge orders child support it is usually back dated to the original date filed. That would mean a huge lump sum for you to pay! Paying support now is not only the right thing to do but it will demonstrate to the courts that you understand your obligation to support and care for your child and will most likely consider your support efforts when determining custody and visitation. Also, try to pay with a check or obtain a receipt if you are paying cash so you can provide proof if there is a dispute.
  4. If you have sexual intercourse with someone other than your spouse at any time while still legally married, then you are committing adultery! Same rules apply before separation as well as after separation.  If the court finds out that you did indeed commit adultery then the courts can ban you from spousal support.
  5. Consult with your attorney before dating. You shouldn’t date around your children and especially have someone of the opposite sex sleep the night over. If this is something you must do then I advise you to have your partner spend the night when your children are with your ex. Virginia case law provides that having a date spend the night in the presence of your child is exposing your child to an immoral environment that is not healthy. Doing this can be held against you in your custody case.
