With almost all child custody cases you have child support. The guideline for child support is set by Virginia law. However; changes in circumstances could warrant a change in your child support calculation. Alimony is mostly determined by a number of factors and the type of support you can receive. All of this varies from one case to another and from person to person depending on the deciding factors. The way you can receive the support either weekly, bi-weekly, monthly or in one lump sum and the length also varies.

There are two types of alimony:

Permanent Alimony is an indefinite support of alimony that only terminates with the death of either spouse or the remarrying of the dependent spouse.

Temporary Alimony is alimony awarded during litigation or as a rehabilitative alimony. Alimony during litigation also known as “pendent lite”, this is granted to the dependent spouse by the courts before the divorce is made final. This is usually done to help cover the living expenses of the dependent spouse and is usually awarded for a short time.

There are two categories of payments that follow the decree:

Technical Alimony is when the agreement states the payments are based upon conditions decided and set forth. When these conditions have been met or have NOT been met then it is possible to alter the amount of support.  Either spouse can petition the courts for an increase or a decrease in alimony payments.

Fixed Alimony is exactly how it is said; a fixed amount that cannot be altered or modified by the courts. This should be stated clearly in the agreement between the two.

Some of the factors that are used in determining the amount and duration are considered by most of the following factors below:

 The obligations and financial needs and resources of both parties including but not limited to

All income and assets

Marital property

Financial obligations

Profit sharing and retirement

The earning ability of each party

What properties, if any do the spouses own?

Is either party making payments now and what money is owed?

Did one spouse stay home and keep house and care for the children while the other spouse obtained an education or worked to provide financially?

Which party has retirement benefits? With this the court can decide of a pension plan and benefits package to be able to protect the dependent spouse.

The earning ability of the dependent spouse

Has the person ever worked before

Some of the salaries or wages that were made

With that said salary is it possible to support their self and partially support the children

Is it financially realistic  for the spouse to stay home and care for the children rather

The opportunity, ability of and the time and cost for one to obtain the education or training to find suitable employment.

The standard of living during the marriage

The duration of the marriage

Usually the longer the marriage, the greater interdependence of the spouses and the lifestyle established.

Monetary and non-monetary contributions of each party

Did the stay at home duties enable the spouse to focus on building a career to support the family

The circumstances that lead up to the reason for divorce

The grounds for divorce are very important. In Virginia, the finding of Adultery, Buggery or Soddomy will bar permanent alimony. In a decision regarding “manifest injustice”, the degrees of fault during the marriage and the relative economic circumstances of the parties would be considered and would be an exception to the barring of permanent alimony.

The ages, physical and mental conditions of each party are considered

An older or disabled party is more likely to be awarded support than a younger, able bodied one.

The court will not award support to a person who is fully capable of working regardless of their desire to not work.

Any agreement between the parties

Are there any agreements or a separation agreement in place already

The ability of the party from whom alimony is sought to meet his or her own needs while still being able to provide the support of the dependent party

What does the financial future look like

What is the real income of the party

What financial assets that were gained as a couple

Is there going to be an increase or decrease in salary amount

Is there an inheritance expected

The Virginia code is interpreted by the courts mainly on a case by case basis and much of the law of alimony is contained in case law. 1. I encourage you to keep a journal. Start one today and back date it with any information that you can remember. In this journal you would put everything inside; from important dates and times to conversations and incidents that occurred. If this is a divorce and or custody case then it could possibly be a year or so before you actually go to court. Trying to remember important dates or incidents will be hard to do especially during court when you may have to testify about these dates. Usually if you refer to your journal when you are asked to testify, your testimony will be much more credible.
2. Do not sign anything with your spouse until your attorney has reviewed it. It doesn’t matter what it is, what it’s typed on, whether handwritten or notarized, do not sign it. If you make an agreement with your spouse that agreement can easily be made the court order in court. Do not legally bind yourself to an agreement without discussing where you stand with your attorney. If you do not have an attorney at this moment I advise you to retain one tomorrow. 3. If your child/children are not living with you then I recommend paying child support to your ex partner as soon as possible. If your ex files for child support it could be several months before your case is heard by a judge. When a judge orders child support it is usually back dated to the original date filed. That would mean a huge lump sum for you to pay! Paying support now is not only the right thing to do but it will demonstrate to the courts that you understand your obligation to support and care for your child and will most likely consider your support efforts when determining custody and visitation. Also, try to pay with a check or obtain a receipt if you are paying cash so you can provide proof if there is a dispute.
4. If you have sexual intercourse with someone other than your spouse at any time while still legally married, then you are committing adultery! Same rules apply before separation as well as after separation.  If the court finds out that you did indeed commit adultery then the courts can ban you from spousal support.
5. Consult with your attorney before dating. You shouldn’t date around your children and especially have someone of the opposite sex sleep the night over. If this is something you must do then I advise you to have your partner spend the night when your children are with your ex. Virginia case law provides that having a date spend the night in the presence of your child is exposing your child to an immoral environment that is not healthy. Doing this can be held against you in your custody case.
